A Safe Work Method Statement — commonly called a SWMS — is a document that identifies the high-risk construction work on a job and sets out how that work will be carried out safely. Under Australian WHS legislation, a SWMS is not optional for certain types of work. When is a SWMS legally required?

What must a SWMS include?

There is no single mandated template format, but the regulations specify what a SWMS must cover:

The SWMS must be kept at the workplace and made available to workers, health and safety representatives, and inspectors on request. Workers who are about to carry out the high-risk construction work must be consulted in preparing the SWMS and must sign to confirm they have read and understood it before starting work.

Do subcontractors need their own SWMS?

Yes. If a subcontractor is engaged to carry out high-risk construction work, they must have a SWMS for that work. As the principal contractor, you need to make sure a SWMS exists before the subcontractor starts. A common and legally defensible approach is for each subcontractor to prepare their own SWMS for their scope, which you review and keep on file.

How specific does a SWMS need to be?

This is where many builders get caught. A generic SWMS that says "fall protection: use harness" is not sufficient for most WHS inspectors. The SWMS should describe the specific activity, the specific hazards present on that particular site, and the specific controls in place. A roofing SWMS for a single-storey weatherboard house looks different from one for a two-storey steel-framed commercial fitout.

The more site-specific the document, the more useful it is as a real safety tool — and the more defensible it is if something goes wrong and the document is scrutinised.

Keeping SWMS documents up to date

A SWMS should be reviewed if there is any change to the work, the site conditions, or the hazards involved. If a new risk emerges that was not covered in the original document, the SWMS must be updated before work continues. Keeping a version-controlled record of these documents matters — both for compliance and for your own protection.
